Applying for Social Security Disability Benefits is relatively easy. However, getting approved for benefits can be a long and exhausting process; especially if you are not represented by an attorney. Unless you have a condition that clearly and completely applies to one of the medical listings, the average length of a claim is between 12 and 18 months. To receive social security disability benefits you must:

First, you have to determine if you qualify for disability. The Social Security Administration’s defines a person as “disabled” is he or she is unable “to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.” 42 U.S.C. 423(d)(1)(A). If you need help determining whether you qualify for disability, let us help you with our Free Disability Evaluation.

Second, complete a social security benefits application. For the best results, you should complete the application with your attorney but, if you want to do it yourself, you can complete an application online, over the telephone, or at your local Social Security Administration office. To apply online, visit www.ssa.gov/applyfordisability.

Third, support your application with medical records. Most applications for social security benefits are initially denied because the applicant fails to provide sufficient medical evidence to support their disability. The reality is that most applications for social security benefits are denied at the first stage, and having an attorney help you with the application does not ensure success. An experience lawyer, however, can help you to gather all the necessary medical information, and that your application for benefits has the best chance for success.

In the event that your application is denied, there is no need to panic. The social security system provides the applicant several more chances to get approved for social security benefits but there are strict timelines that need to be followed to keep your claim alive - an experienced law firm like Meier LLC can make sure you keep those deadlines. If your application for social security benefits has been denied and you need help, call our offices immediately.
